Often work permit applications fall under the open category where applicants don’t need an LMIA and can work for any Canadian employer. This category defines the requirements associated with the application process, which entails:
- Eligibility. This factor centres on the applicant being healthy, qualified for the job with necessary documents to prove, law-abiding with no criminal records, compliant with the duration of stay, and more.
- Labour Market Impact Assessment. A Canadian-based business must carry out a labour market impact assessment prior to hiring the foreign skilled worker. This applies to a closed work permit and involves a detailed investigation of available jobs, and an evaluation of the job market’s current labour needs. Assessments provide an overview of the employer's hiring situation and ensure that the applicant's position won’t be detrimental to the Canadian labour market.
- Job offer or invitation. This allows the potential employee to work in Canada for a limited period.
Once all of the documentation is received, an application form must be filled out and submitted to the immigration department. An immigration officer decides if the application meets the standards. The decision is based on the following:
- The nature of the job and the skill level of the applicant
- The wage of the job
- Whether there are enough jobs in the region of the applicant’s residence to absorb the skills
- Whether the applicant has sufficient work experience
Other aspects of the applicant’s record will be taken into consideration before arriving at a decision to issue the individual a work permit. Work permits are open to people seeking permanent residency or a dependent status based on humanitarian and compassionate reasons. Notwithstanding, there are exemptions to work permit applications, ranging from farm workers to foreign representatives.
